Below are answers to common questions about the trademark process.
Filing Only is the fastest and lowest-cost option. It includes attorney preparation of the USPTO trademark application and filing with the USPTO. It does not include a trademark search, legal opinion on risk, or Office Action responses if the USPTO raises issues.
Filing Only is best for clients who have already evaluated trademark risks and want to move forward immediately without a search.
Search + Review includes a comprehensive trademark clearance search, attorney review of potential conflicts, and a 30-minute attorney session to discuss the results. No trademark application is filed as part of this option.
This option is best for clients who want more clarity before deciding whether filing makes sense.
The Trademark Protection Package includes a comprehensive trademark clearance search, attorney strategy consultation, attorney-prepared trademark application, response to the initial USPTO Office Action if one is issued, Statement of Use guidance if applicable, and monitoring of the application until registration.
Many clients choose this option because it provides the most protection during the trademark process. It includes both the search and filing, plus attorney support if the USPTO raises issues during examination.
Yes. Clients who begin with Search + Review may later decide to move forward with filing or the Trademark Protection Package.
No attorney can guarantee registration. The USPTO decides whether a mark qualifies for protection. A search and legal review can help reduce risk, but they cannot eliminate it.
